Fred is hosting an Open House on Sunday afternoon. Joe and Mary walk in, fall in love with the house, and make a full price, cash offer, "on the spot."
Who does Fred represent in this transaction?
Alice walks into a real estate office and says to Jane, the broker sitting at the front desk, "I just drove by a house that is for sale at 789 Maple St. and I want to buy it. Can you help me?"
Who does Jane represent in this transaction?
While dinning with family, cousin Bertha asks Jim, "How much are you asking for that house you have your sign on just up the street from where I live?" Jim replies, "$239,900, you want to buy it?" Before departing, Bertha makes an offer, with Jim, on his listing.

When does an offer become a contract?
Though the answer to this "basic" question may appear obvious, there have been instances where real estate agents learned almost too late the legaltities of this question. For example, the N.C. agent who "sold" one house to three different buyers in one day! All because he did not understand the potential power of initials on a contract.
